What does a trustee do?

In general, all trustees administering California trusts are responsible for:

  • Identifying all of the assets that are owned or should be owned by the trust
  • Determining the value of those assets
  • Identifying the beneficiaries of the trust
  • Providing certain information to those beneficiaries
  • Accounting for how trust resources are managed
  • Making payments to beneficiaries according to the terms of the trust

Should I serve as a trustee?

Serving as a trustee is difficult and time-consuming. It also carries risks to the trustee: a trustee can be sued for failure to carry out the instructions of the trust (which are not always easy to understand).
